"# $/&$$&&2 ! )# 45 6 *(# #* # (# ! $ The case of the prosecution is that on 17.06.2001, the petitioner was booked for rash and negligent driving of Jeep , )%10(0-/&2 and thereby causing death of Muni Ram, Shamer Lal, Chhotu Ram, Darshan Singh, Puran Chand, Raj Kumar, Krishan Lal and Subhash Chander and injuries to Roshan Lal, Suraj Bhan, Basant Singh, Prem Singh and Gurdeep Singh. Pursuant thereto,
the petitioner was tried in the Court and vide order dated $$%%$&&' passed by the then Chief Judicial Magistrate, Muktsar, the petitioner was convicted and sentenced to undergo RI for two years and to pay a fine of Rs.5000/- and in default thereof, to further undergo RI for three months under Section 304-A of IPC. The petitioner was further sentenced to undergo RI for six months and to pay a fine of Rs.500/- and in default thereof, to further undergo RI for one month under Section 337 of IPC. Both sentences were ordered to run concurrently. Feeling aggrieved by the said conviction and sentence, the petitioner preferred an appeal before the Sessions Court, Muktsar, wherein learned Addl. Sessions Judge, (Adhoc), Fast Track Court, Muktsar vide judgment dated 23.02.2008 dismissed the appeal while upholding the judgment of conviction and order on sentence dated 22.11.2007.
