Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.124 dated 27.08.2015 under Section 406 IPC, registered at Police Station Beas, District Amritsar. I have heard learned counsel for the petitioner and have gone through the record.

From the record, I find that FIR in the present case has been registered on the basis of the application given by District Manager, PUNSUP. As per the allegations, the paddy was given to M/s Hari Om Rice Mill and Smt.Pooja Rani and Smt.Aarti Joshi, are the partners of the said mill. It is stated that miller has deposited only 8095 bags till the stipulated period to FCI and remaining rice of 23621 bags was not deposited with PUNSUP. CRM No.M-37322 of 2016 -2bags of rice were lying in the Hari Om Rice Mill and remaining rice has not been deposited, the cost of which comes to `1,27,13,946/-. Keeping in view the facts and circumstances of the present case, nature and gravity of the offender and in view of the fact that there is misappropriation of huge quantity of paddy supplied by PUNSUP, I do not find it a fit case where petitioner is entitled to benefit of anticipatory bail. Therefore, finding no merit in the present petition, the same is dismissed.
