NARESH KUMAR SANGHI, J.(ORAL) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of regular bail to the petitioner, Pardeep Kumar @ Sonu, son of Surinder Kumar, resident of H.No.34, Gali No.5, Bank Wali Gali, Vijay Nagar, Tehsil and District Amritsar, who has been booked for having committed the offences punishable under Sections 420, 467, 468 and 471, IPC, in a case arising out of FIR No.276, dated 20.08.2015, registered at Police Station, Civil Lines, Amritsar.

Learned counsel contends that the petitioner, who is behind the bars since 20.08.2015, is neither required nor MEENU 2015.11.02 17:49 I attest to the accuracy and authenticity of this document chandigarh

CRM-M-36441-2015 (O&M) -2involved in any other case; all the offences for which the petitioner has been booked are triable by learned Judicial Magistrate and after completion of the investigation, the chargesheet (challan) has been presented for prosecution of the petitioner and, as such, his further incarceration would not be of any consequence.

Learned counsel for the State, on instructions from HC Baldev Raj, Police Station, Civil Lines, Amritsar, has very fairly conceded that the petitioner is neither required nor involved in any other case and he is behind the bars from 20.08.2015 and after investigation of the case, the charge-sheet (challan) has been presented.

In view totality of the facts and circumstances of the case, the present petition is allowed. The petitioner, Pardeep Kumar @ Sonu, son of Surinder Kumar, resident of H.No.34, Gali No.5, Bank Wali Gali, Vijay Nagar, Tehsil and District Amritsar is directed to be released on bail during pendency of the trial of the present case subject to his furnishing bonds to the satisfaction of learned trial Court.
