CRM-M-37413 of 2018 Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to petitioner Dhanpat alias Rohit in a case arising from FIR No.212 dated 18.06.2018 registered under Sections 22 and 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Ladwa, District Kurukshetra. According to the prosecution, 1725 intoxicating tablets were recovered from one Irfan Khan, on whose disclosure RAVINDER SINGH 2018.09.27 18:05 I attest to the accuracy and authenticity of this document statement, petitioner was arrested.

-2CRM-M-37413 of 2018 (O&M) Learned counsel for the petitioner inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovered article was a narcotic substance. Petitioner is in custody since 26.06.2018. In view of above, but without expressing any opinion on the merits of the case, the petitioner is granted interim bail subject to furnishing personal bonds and two sureties of `2.00 lakh each, to the satisfaction of Special Court concerned only till receipt of the FSL report.

The petition stands disposed of accordingly.
