Through this petition filed under Section 438 Cr.P.C., the petitioner seeks grant of anticipatory bail in FIR No.458 dated 08.08.2016, registered under Sections 147, 148, 149, 285, 323, 34, 341, 452 and 506 IPC (Sections 307 and 324 IPC added subsequently) and Section 25 of the Arms Act, at Police Station City Fatehabad, District Fatehabad. While issuing notice of motion on 24.10.2016, this Court had granted ad-interim anticipatory bail to the petitioner, subject to his joining investigation and conditions envisaged under Section 438(2) Cr.P.C. At the very outset, learned counsel for the petitioner submits that co-accused Sonu son of Raghbir @ Gattu, who has been attributed an identical role as the petitioner, had approached this Court for the grant of anticipatory bail through Crl. Crl. Misc. No. M-37345 of 2016 allowed by this Court on 30.11.2016. On the ground of parity, anticipatory bail for the petitioner is prayed.
I have gone through the afore-referred order passed by this court in the case of Sonu son of Raghbir @ Gattu, as also the allegations in the FIR and find that on parity, the petitioner is also entitled to grant of concession of anticipatory bail.
Learned State counsel, on instructions from ASI Sarabjit Singh, submits that the petitioner has joined investigation and is no longer required for questioning by the investigating agency.
In view of the above, the petition is allowed and order dated 24.10.2016 granting ad-interim anticipatory bail to the petitioner is made absolute subject to the conditions prescribed under Section 438(2) Cr.P.C. ( DEEPAK SIBAL ) JUDGE January 19, 2017 monika Whether speaking/reasoned ?
