**** RAJ MOHAN SINGH, J.(Oral) CM No.8725-CWP of 2021 Prayer made in this petition is for preponement of date of hearing of the main case, which is fixed for hearing on 20.01.2022.
For the reasons mentioned in the application, the same is allowed. Date of hearing of the main case is preponed and the same is taken up today.
Vide order dated 23.09.2021, the matter was referred to the Mediation and Conciliation Centre of this Court and all the parties were directed to appear before the Mediator. In view of report of the Mediator, both the parties have amicably settled the dispute. The parties have voluntarily arrived at the settlement on the following terms and conditions:- (i) Both the parties have agreed that the petitioner/tenant-first party will hand over the vacant possession of the demised premises under his tenancy to the landlord(s)/second party on or before 15th October, 2021. It has been agreed that first party shall inform second party at the time of vacation of the demised premises and hand over the key to them. The second party shall give cheque of Rs.1,60,000/- (one lakh sixty thousand only) to the first party at the time of handing over the keys. The amount is being given in lieu of the fitting and fixtures in the rented premises done by the first party.
(ii) It is further agreed that the second party shall waive off the entire arrears of rent as well as future rent due till vacation of the demised premises.
(iii) It is further agreed between the parties that the first party/tenant will not create any charge, encumbrance over the demised premises and will hand over the vacant possession thereof on the agreed date. (iv) It is further agreed between the parties that they will withdraw/get disposed of the respective cases filed by them pending in different Court as described in Para4(i to viii) in terms of settlement."
With the execution of the settlement, the dispute in question pending between the parties would come to an end. Both the parties undertake that they would abide by the terms and conditions of the settlement meticulously. In view of settlement dated 30.09.2021, learned counsel for the petitioner wishes to withdraw the present petition.
Dismissed as withdrawn.
