RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioners - Satnam Singh and Avtar Singh - in a case arising from FIR No.108 dated 31.07.2017 under Sections 452, 326, 325, 324, 323, 506, 148 and 149 IPC registered at Police Station Majitha, District Amritsar Rural.

According to the prosecution, petitioner No.1 Satnam Singh gave a 'datar' blow on the nose of the complainant on account of which the complainant suffered a cut on his nose, whereas petitioner No.2 Avtar Singh gave an axe blow from its reverse side on the back of left hand of the complainant which resulted into a fracture.

Learned counsel contends that both the petitioners are in custody since 10.08.2017. Nothing is to be recovered from them. Challan has not been presented as yet. Conclusion of trial shall take a long time, therefore, no useful purpose would be served by keeping the petitioners behind bars. Co-accused Gurmeet Kaur and Sukhwinder Kaur have already been granted

On the other hand, learned State counsel vehemently opposed the prayer for grant of regular bail to the petitioners. Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioners are ordered to be released on bail, on their furnishing bail bonds and surety bonds, to the satisfaction of Illaqa Magistrate/Duty Magistrate concerned.
