Dated Police Station Section/s 5.12.2023 City Kharar, District SAS Nagar 419, 420, 467, 468, 471, 120B IPC, wherein offence under Section 201 IPC was added later on GURVINDER SINGH GILL, J. (Oral) 1.
The petitioner seeks grant of regular bail in respect of the aforementioned FIR.

The allegations, in nutshell, are that the land belonging to complainant - Harwinder Kaur Brar was sold by the accused by way of impersonation. 3.
Learned counsel for the petitioner submitted that the petitioner is nowhere named in the FIR and has been nominated subsequently on the basis of a supplementary statement to the effect that the petitioner had prepared the Pankaj Kakkar 2024.04.25 17:56 I attest to the accuracy and authenticity of this document
CRM-M-19344-2024 (O&M) ( 2 ) 2024:PHHC:056615 alleged fake documents and had arranged for a lady to impersonate as the complainant.

Learned counsel for the petitioner submits that an identically situated coaccused namely Faljeet Singh has already been granted by this Court vide order dated 3.4.2024 passed in CRM-M-13638-2024 (Annexure P-2) and, as such, the petitioner also deserves the same concession on grounds of parity particularly since the petitioner otherwise has a clean record. 5.
Learned State counsel, however, opposed the petition on the ground that the petitioner having been named by the complainant in supplementary statement, his complicity is clearly evident. It has been informed that the petitioner as on date has been behind bars since the last about 2 months and 24 days and challan already stands presented and that the petitioner is not involved in any other case.

Without commenting anything as regards merits of the case, but having regard to the custody of the petitioner i.e. about 2 months and 24 days and also the fact that challan already stands presented and that the petitioner otherwise has a clean record and also while bearing in mind that identically situated co-accused Faljeet Singh has already been granted by this Court vide order dated 3.4.2024 passed in CRM-M-13638-2024 (Annexure P-2), the instant petition is accepted and the petitioner is ordered to be released on regular bail on his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned. 25.4.2024 ( Gurvinder Singh Gill ) pankaj/geeta Judge Whether speaking /reasoned Yes / No Whether Reportable Yes / No Pankaj Kakkar 2024.04.25 17:56 I attest to the accuracy and authenticity of this document
