(Oral) The allegations against the petitioner in this regular bail under section 439 Cr.P.C. are that he was found in illegal possession of one kg. of opium a non-commercial quantity while he was caught hold by the police coming holding a plastic bag in his left hand on 28.6.2015. The contentions of counsel for the petitioner that the petitioner is in custody since more than five months and the trial is not likely to be concluded in near future could not be controverted on behalf of the State. Keeping in view the period of incarceration and noncommercial quantity of contraband, no purpose will be served by retaining the petitioner in jail.
