Present petition under Section 482 Cr.P.C. seeking direction to the respondents to take appropriate action against Vijay Kumar, Tilak Raj Sharma and Sushil Raj Sharma by registering a case against them. Learned counsel for the petitioner contended that petitioner had approached the police authorities including the Commissioner of Police, Ludhiana but no action was taken. However, learned counsel fairly conceded that petitioner has not approached the learned Area Judicial Magistrate for availing the provisions as detailed in Section 156(3) Cr.P.C. As per the view taken by the Hon'ble Apex Court in Sakiri Vasu v. State of U.P. & Others 2008(1) RCR (Criminal) 392, this petition is not maintainable and the same is hereby dismissed.
