(Oral) Present petition has been filed under Section 482 Cr.P.C. for seeking permission to go abroad (Australia) for period four weeks to attend the date of hearing i.e. 31.10.2016 fixed in the Magistrates Court at Perth. Learned counsel for the petitioner submits that the petitioner has to go abroad (Australia) to attend the Court proceedings and this fact is apparent from the letter dated 27.09.2016 (Annexure P-8). Even during the pendency, on an earlier occasion also the petitioner was granted the permission to go abroad for one month as is clear from order dated 01.09.2016 (Annexure P-4). Further it has been informed that after coming back from Australia, pursuant to order dated 01.09.2016 (Annexure P-4), the amount of surety of `5,00,000/- has not been released to the petitioner. CRM-M-37520-2016 (O&M) -2Learned State counsel has informed that the challan is prepared and the same is likely to be present shortly. Keeping in view the fact that the petitioner is to appear as a witness in Court proceedings at Perth (Australia), the present petition is alllowed and the petitioner is permitted to attend the Court proceedings pending at Perth (Australia) for a period of one month, subject to surety of `5,00,000/-, to be deposited with the trial Court. In case the amount of earlier surety deposited by the petitioner before the trial Court is not released to her, then the petitioner would not be required to furnish the fresh surety.
