(ORAL) The petitioner herein seeks the relief of regular bail in the criminal case pertaining to the FIR bearing No.66 dated 07.02.2021 registered at Police Station City Jind, District Jind, under Sections 323, 304, 506 read with Section 34 IPC, with the allegations that during his scuffle with complainant Rakesh Kumar, the petitioner pushed the mother of the complainant whose head struck against the wall, resulting into her death. Status-report filed on behalf of the respondent-State, by way of the affidavit of Deputy Superintendent of Police, City Jind and the postmortem report of the victim have already been filed. I have heard learned counsel for the petitioner as well as learned State counsel in this petition and have also perused the file thoroughly. behind the bars since 08.02.2021 and is not involved in any other criminal case of the similar nature and the Challan has already been presented in the Court and the charges have also been framed and in these circumstances, the petitioner deserves the relief as prayed for in this petition. Learned State counsel does not dispute the afore-referred factual position but he opposes the prayer of the petitioner on the ground of gravity of the allegations as levelled against him.

Keeping in view the above-discussed factual position as well as the fact that the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Pankaj is ordered to be released on regular bail subject to his furnishing the requisite personal as well as surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
