******* SURINDER GUPTA, J.(Oral) Learned counsel for the petitioner submits that only apprehension of the petitioner is that trial Court may ask the petitioner to cross-examine Sumit Singh, who has been appointed as authorised signatory on behalf of Axis Bank on the affidavit of Mr. Deepak Dhiman, who was earlier authorised signatory of the bank and filed his affidavit. The above submission of learned counsel for the petitioner is misplaced. Learned trial Court will look into this fact while allowing crossexamination of Sumit Singh as the cross-examination of only that witness can be allowed, who has put himself for examination-in-chief, which is either recorded in Court or through tendering affidavit. In view of above clarification, learned counsel for the petitioner seeks permission to withdraw the petition.
