Petitioner has filed this second petition under Section 439 Cr.P.C. for grant of regular bail in case FIR No.95 dated 25.04.2017 under Section 22 of the NDPS Act, registered at Police Station Shahkot, District Jalandhar Rural.

Ms.Monika Jalota, DAG, Punjab, has put in appearance on behalf of the respondent-State and contested the petition. I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that in the present case, as per the allegations, petitioner is found in conscious possession of 152 grams of intoxicant powder containing salt 'Diphenoxylate Hydrochloride', which VINEET GULATI 2018.09.25 16:16 I attest to the accuracy and authenticity of this document Chandigarh falls under commercial quantity. Section 37 of the NDPS Act bars the grant
CRM No.M-37647 of 2018 -2of bail to the accused in the case of commercial quantity. Therefore, finding no merit in the present petition, the same is dismissed.
