Learned counsel for the petitioner submits that the petitioner is fully eligible for promotion to the post of Sub Divisional Engineer (Civil) and though the similarly situated employees were promoted vide order dated 14.08.2023 (Annexure P-10), but, the claim of the petitioner has not been considered, hence, the respondents are under obligation to consider the claim of the petitioner for promotion to the post of Sub Divisional Engineer (Civil) w.e.f. the date when the similarly situated employees were considered and promoted to the post of Sub Divisional Engineer (Civil) especially when the posts of Sub Divisional Engineer (Civil) are still lying vacant. 2.
Learned counsel for the petitioner submits that the petitioner has already raised the said grievance in the representation dated 13.04.2024 (Annexure P-15) but the same is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a direction is issued to the respondents to decide the same by passing an appropriate speaking order in a time bound manner. 3.

Learned counsel for the petitioner submits that keeping in view the statement of learned State counsel, the present petition may kindly be disposed of having been not pressed any further. 6.
