 ) This intra.court appeal is directed against the judgment and order dated 18.03.2019 passed by the learned Single Judge disposing of the writ petition filed by the appellant herein seeking a relief that in pursuance to his appointment on the post of Presiding Officer, Debts Recovery Tribunal, he may be given posting at Chandigarh instead of Ranchi. The appointment order is dated 08.10.2018. Almost nine months have passed and the appellant has not yet joined despite a reminder dated 20.10.2018 requiring him to join immediately or latest by 08.11.2018 positively. "#$%&' ()/#0 When confronted with the observation that the appellant is not willing to work and is actually passing away the time by involving the respondents in unnecessary litigation, why his appointment should not be cancalled, learned counsel for the appellant sought leave of the Court to permit withdrawal of the appeal.

We permit the appellant to withdraw the appeal but subject to the condition that in case his appointment has not been cancelled by the respondents themselves, the appellant shall join at the place of his posting within a period of seven days failing which the appointment order shall be deemed to have been cancelled.

With the aforesaid observation, the appeal stands dismissed as withdrawn.
