* * * * Petition filed by the appellant under Section 13 of the Hindu Marriage Act for dissolution of the marriage by way of decree of divorce was dismissed. Hence, this appeal at the instance of the husband. The appeal was filed by Mr. Premjit Kalia, Advocate. He had not put in appearance and when contacted on telephone stated that he is no longer the counsel in this case as the client had taken the brief from him. Mr. H.S. Sirohi, Advocate, who had filed his Memo of Appearance on behalf of the respondent when contacted on telephone, also stated that the client had taken away the brief from him and he is no longer the counsel. In view of the above, notices were issued to both the appellant as also the respondent. Notice issued to the respondent has been received back with the report that the house is locked and no whereabouts are known.

Notice issued to the appellant has also been received back unserved with the report that the appellant could not be traced at the available address. In the circumstances, it appears to us that the parties must have settled the disputes and the appeal consequently be consigned to the record. Liberty is, however, granted to the parties to get it revived, in case of need, by moving an appropriate application.
