The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to grant him three marks for 'C' Grade NCC Certificate.

The petitioner pursuant to advertisement No. 3/2018 dated 16.04.2018 applied for the post of Sub Inspector (Male). He cleared written test followed by physical test. His name did not figure in the final select list. He filed instant petition before this Court claiming three marks for 'C' Grade NCC Certificate. During the pendency of instant petition, the respondent realized its mistake and decided to grant three marks for 'C' Grade NCC
CWP No. 10594-2019 -2Certificate to him. He was awarded marks, however, not permitted to join. This Court vide order dated 16.02.2024 directed the respondent to issue appointment letter to petitioner as well as two similarly situated persons namely Rishi and Pardeep Antil. The order dated 16.02.2024 reads as:- "During the course of arguments, it has not been disputed that Vikram Singh-petitioner in CWP-105942019, Rishi-petitioner no.2 in CWP-6186-2019 and Pardeep Antil-respondent no.5 in CWP-26380-2021 had earlier wrongly not been selected and the respondent authorities have after realizing the mistake recommended the said persons for being appointed to the post of Sub Inspector (Male) with respect to the post to be filled in pursuance of the advertisement no.3/2018.
The entire issue as to which candidate would make to the final select list is pending adjudication as several issues have arisen in the present matters. One of the issues, which have been raised by the petitioners in CWP-26380-2021, who are the persons who have been issued show cause notices in order to appoint the above said three persons, is that a large number of persons, who are not entitled to get the benefit of marks on account of being orphan, have been given the said benefit and have been wrongly included in the select list and the said issue is pending final adjudication in LPA-1113-2023, which is listed for hearing on 20.03.2024.
CWP No. 10594-2019 -3thus, the matters in any case should await the decision of LPA-1113-2023.
Learned counsel for Vikram Singh-petitioner in CWP-10594- 2019, Rishi-petitioner no.2 in CWP6186-2019 and Pardeep Antil respondent no.5 in CWP26380-2021 has, on the other hand, submitted that in spite of being recommended by the respondent authorities and in spite of being higher in merit they have not been issued the appointment letters without any fault of their and has further submitted that whatever be the fate of the said LPA-1113-2023, the petitioners in any case would be entitled to appointment. It is prayed that in the said circumstances, respondent no.2 be directed to issue appointment letters to the said three persons and they be permitted to discharge their duties and the same be made subject to the decision of the writ petitions.
Keeping in view the abovesaid facts and circumstances, this Court is of the opinion that the ends of justice would be met in case respondent no.2 is directed and is accordingly directed to issue appointment letters to Vikram Singh-petitioner in CWP-10594-2019, Rishi-petitioner no.2 in CWP-6186-2019 and Pardeep Antil-respondent no.5 in CWP26380-2021, within a period of two weeks from today, so that the said persons are able to discharge the duties as Sub Inspectors, subject to the final decision of the writ petitions. Adjourned to 21.05.2024.
A photocopy of this order be placed in the files of the connected cases."

In pursuance to aforesaid order, the respondent issued appointment letter to petitioner as well as Rishi and Pardeep Antil. They have joined service.

Learned State counsel concedes that petitioner was found eligible for claimed marks. The result was revised and he being meritorious was selected.

As the petitioner stands selected, no further order is warranted. 6.
