Through the present petition filed under Section 438 Cr.P.C. the petitioner seeks the grant of anticipatory bail in FIR No.135 dated 22.06.2020, registered under Section 61 of the Punjab Excise Act, 1914 at Police Station Maur, district Bathinda.

The case of the prosecution is that the petitioner has been found in illegal possession of 10 litres of liquor. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case; no recovery has been effected from him; he is not involved in any other criminal case and that under the interim order of this Court dated 15.07.2020 he has not only joined the investigation but has fully cooperated with the investigating agency. Learned State counsel, on instructions from ASI Gurmail Singh, submits that the petitioner has not only joined investigation but has fully cooperated with the investigation agency and that his custodial interrogation is not required at this stage.

CRM-M-18764-2020 [ 2 ] Keeping in view the totality of the above facts and especially in view of the statement recorded by learned State counsel that under the interim order of this Court the petitioner has joined investigation/cooperated with the investigating agency and that his custodial interrogation is not required, the order of this Court dated 15.07.2020, granting ad interim anticipatory bail to the petitioner is made absolute.
