This is a petition against the order dated 21.10.2013 whereby the trial Court declined to grant permanent exemption to the petitioners.

At the very outset learned counsel for the petitioners has argued that he would not seek permanent exemption but the fact of the matter is that the petitioners are ladies. The other accused have not been served and at least till such time that the trial starts the petitioners should be permitted to appear through counsel. Further permission be granted to them to move for exemption once the trial starts. Learned counsel for the respondent has fairly accepted that some of the accused have yet not been served. CRM-M No.39582-2013 offence and , therefore, should not be granted any exemption. In my opinion the argument of learned counsel for the petitioners has more weight.

In the circumstances this petition is disposed of with the order that till such time the trial starts, the petitioners would be exempted from appearing in the Court and would be permitted to appear through their counsel. Once the trial starts they would at least have the right to move an application for exemption which would be decided on its own merit.
