The petitioners through instant petition under Articles 226/227 of the Constitution of India are seeking setting aside of letter dated 06.08.2007 whereby Department of Rural Development and Panchayat granted approval to Gram Panchayat to levy transit fee/tax upon the vehicles moving through the roads passing through the limits of Gram Panchayat. 2.
On 23.08.2007, notice of motion was issued and operation of impugned order was stayed. By order dated 03.11.2008, interim order was modified. It was clarified that any payment made towards toll tax will be subject to the decision of this writ petition. 3.
Learned State counsel has submitted that toll tax was not levied after two years, thus, petition has rendered infructuous. 4.
