The petitioner through instant petition under Article 226/227 of the Constitution of India is seeking setting aside of letter dated 09.07.2007 whereby she was asked to refund a sum of Rs.1,01,113/-. She is further seeking direction not to reduce her family pension. 2.

On 23.08.2007, following order was passed by this Court:- "The husband of the petitioner, who was working as Assistant Sub Inspector in Punjab Police was killed by the terrorists on 9.10.1990. The petitioner, who is his widow was granted the family pension. Now, vide impugned order Annexure P-3, the respondents are recovering a sum of Rs.1,01,113/- on account of the fact that her son has got employment on compassionate ground on 29.10.2004. Learned counsel contents that the petitioner who is widow, has been getting family pension on account of death of her husband and merely because her son has DEEPAK BISSYAN 2025.08.07 18:29 I attest to the accuracy and integrity of this document

CWP-13076-2007 (O&M) -2been appointed on compassionate grounds, cannot be a ground to withdraw the family petition of the petitioner. Learned counsel further submits that no opportunity was given to the petitioner before passing order Annexure P-3.

In the meantime, recovery, if any, shall remain stayed."

Considering the amount and efflux of time, this Court finds it appropriate to make the aforesaid order absolute. 4.
