[The aforesaid presence is being recorded through video conferencing since the proceedings are being conducted in virtual Court] The petitioner Company is engaged in the import and trading of old and used spare parts. Its one of the consignments imported through Bill of Entry No.7651198 dated 13.5.2020 was not being cleared lying at the ICD, Garhi Harsaru inspite of custom duty having been paid and inspection carried out by the Customs Approved Chartered Engineer.

Claim in the present petition is for issuance of a writ of mandamus directing the respondent-Authorities to release the goods/ container imported against the aforesaid Bill of Entry No. 7651198 dated 13.5.2020, or in the alternative directing the decision of representation dated nil (P-7).

CWP 9835/2020 At the time of hearing, Mr.Bindlish, learned counsel for respondents states that vide letter dated 14.7.2020 issued by the Superintendent, ICD-Garhi Harsaru, it is conveyed that the goods have been custom cleared and therefore, the writ petition has become infructuous. Copy of the letter dated 14.7.2020 has been taken on record as Mark-A for the purpose of record. In view of the stand of learned counsel for the respondents, counsel for the petitioner concedes that the present writ petition has become infructuous.

Dismissed as having become infructuous.
