This petition has been filed under Section 528 of BNSS (482 Cr.P.C) for quashing of order dated 06.02.2024 (Annexure P-4) passed by ld. Addl. Sessions Judge, SAS Nagar in CRM-499-2023 in CRA-20 of 2024 titled as Bagga Singh Vs State of Punjab vide which the non bailable warrants of arrest were issued which is result of FIR No. 170 dated 02.09.2017 under Section 279 and 304-A of IPC registered at Police Station Lalru, Tehsil Derabassi, District SAS Nagar (Mohali) with a prayer for quashing of proclaimed offender order dated 27.08.2024 passed by ld. JMIC, Derabassi, Distric SAS Nagar in CRM-267-2023 in titled as State of Punjab Vs Bagga Singh vide which the petitioner was declared as proclaimed offender. 2.
Learned counsel for the petitioner submits that the petitioner could not appear before the learned Trial Court as he was under the bona fide impression that he had already filed the appeal and furnished bail bonds. CRM-M-19293-2026 lack of proper communication regarding the proceedings. It is further prayed that the petitioner is ready and willing to join the proceedings before the Court and the impugned order dated 17.10.2025 (Annexure P-2) be set aside. 3.

On the asking of the Court, Mr. P.S.Pandher, Asst. A.G.Punjab accepts notice on behalf of the respondent-State. 5.
I have heard learned counsel for the parties and gone through the case file.

In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere with the impugned orders passed by the Courts below. However, in case the petitioner surrenders before the trial Court within a period of 07 days from today at 10:00 A.M and moves an application for grant of regular bail, the same be allowed and his bail bonds and surety bonds be accepted to the satisfaction of the Court concerned. 7.
