Through this petition under Section 439 Cr.P.C., petitionerJagtar Singh @ Taari, has prayed for grant of regular bail in case FIR No. 0051 dated 29.06.2016, registered under Sections 420 and 120-B IPC at Police Station Cantt. Bathinda, District Bathinda. 2.

Learned counsel for the petitioner contends that the petitioner was the employee of firm M/s DDB Cement and Building Material. The main accused, namely; Balwinder Singh and Harjinder Singh have been granted the concession of regular bail by this Court vide order dated 07.09.2017 (Annexure P-2) passed in CRM-M-30389-2017. The dispute in between the parties is purely of civil nature. Thus, treating the case of the petitioner on the same parity, he be released on bail. The petitioner is in judicial custody since 10.07.2017.

Considering the overall circumstances of the case and the fact the main accused, namely; Balwinder Singh and Harjinder Singh have already been granted the concession of regular bail by this Court, the petitioner deserves the concession of regular bail. 6.

Thus, without expressing any opinion on the merits of the case and also that the trial is likely to take time, the instant petition is allowed and the petitioner-Jagtar Singh @ Taari, is ordered to be released on bail pending trial, subject to his furnishing adequate bail bonds and surety bonds to the satisfaction of trial Court/Duty Magistrate, Bathinda.
