(Oral) The petitioner prays for grant of regular bail under Section 439 of the Code of Criminal Procedure (in short 'Cr.P.C.') in FIR No.159 dated 02.05.2017, for offence punishable under Sections 148, 149, 323, 324, 307, 452, 506, 212 of the Indian Penal Code, 1860 (in short 'IPC') registered in Police Station Indri, District Karnal. Counsel for the petitioner, at the very outset, submits that he does not press the petition qua petitioner No.1 - Gurmej Singh. Accordingly, the petition is dismissed qua petitioner No.1 - Gurmej Singh being not pressed.
Counsel for the petitioner has submitted that with regard to petitioner No.2 - Parveen Kumar, there are no specific allegation of attributing injury to any of the injured persons. It is further submitted that petitioner No.2 is in judicial custody since 29.06.2017 and the case is still at the investigation stage and he is not required for any other Mohd. Counsel for the State assisted by counsel for the complainant, on instructions from ASI Ved Pal, has opposed the prayer for bail on the ground that 05 persons are yet to be arrested in the case. After hearing counsel for the parties, without meaning to express any opinion on merits of the case, the petition is allowed and the petitioner No.2 namely Parveen Kumar is ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of the trial Court/Illaqa Magistrate. However, it will be open for the prosecution to apply for cancellation of bail, if the petitioner is found involved misusing the concession of bail, in any manner.
