(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for compounding offence under Sections 279, 337 and 338 IPC and setting aside/quashing impugned judgment dated 08.01.2018 in case FIR No.186 dated 29.09.2015, under Section 279, 337, 338 and 427 IPC registered at Police Station Sadar Khanna, Police District Khanna, District Ludhiana and all subsequent proceedings arising therefrom, on the basis of compromise.

Pursuant to order dated 31.08.2018 and 28.09.2018 of this Court, the parties appeared before the trial Court on 25.09.2018 and 23.10.2018 to get their statements recorded. Learned Additional Civil Judge (Sr. Division)-cum-SDJM, Khanna has submitted his reports vide letters bearing No.1319, dated 27.09.2018 and 2082, dated SONIKA 2018.11.03 11:18 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-37911 of 2018 --2-- 26.10.2018 duly forwarded by learned District and Sessions Judge, Ludhiana, vide letters No.858/EC, 27.09.2018 and 972/EC dated 26.10.2018.

According to the reports, learned Additional Civil Judge (Sr. Division)-cum-SDJM, Khanna, is satisfied that matter has been compromised between the parties with their own free will and consent, without any pressure or coercion.

Considering the reports of learned Additional Civil Judge (Sr. Division)-cum-SDJM, Khanna, dated 27.09.2018 and 26.10.2018 and the fact that the compromise will bring peace and harmony in relations between the parties, aforesaid FIR No.186 dated 29.09.2015 including judgment dated 08.01.2018 (P-2) and all subsequent proceedings arising therefrom, are quashed, subject to payment of costs of `10,000/- out of which `5,000/- shall be deposited with the Bar Association of Punjab and Haryana High Court and `5,000/- with the Punjab and Haryana High Court Legal Services Committee within two weeks from today, failing which this petition shall be deemed to be dismissed. Disposed of accordingly.
