The allegations against both the present petitioners are that on 25.8.2015, the accused have assaulted complainant Roshan Lal. It is contended by Mr. Pankaj Bali, counsel for the petitioners DALBIR SINGH TIWANA 2015.11.04 15:01 I attest to the accuracy and authenticity of this document.

CRM-M-36952-2015 & CRM-M-37054-2015 -2that it is no-injury case and that the other injuries are only covered under section 325 IPC and the petitioners are in custody since 10.9.2015 and Mr. Munish Sharma, learned State counsel has squarely accepted that the very applicability of section 307 IPC is debatable issue. However, without going into the merits of the case, in the light of the fact that investigation and trial are not likely to conclude in the near future, this Court is of the opinion that further detention of the petitioners in the present case is not warranted. Accordingly, both the petitioners namely Kamal alias Kamaljeet and Naresh alias Chottu are ordered to be released on regular bail to the satisfaction of learned Chief Judicial Magistrate/Duty Magistrate, Karnal.
