*** H.S. Grewal, J. (Oral) This is a petition for anticipatory bail filed under Section 482 of Bharatiya Nagarik Suraksha Sanhita, (BNSS), 2023 in FIR No.35 dated 24.02.2025 under Sections 318(4), 61(2), 351(2) of BNS, 2023, registered at Police Station City Tarn Taran, District Tarn Taran. 2.

Learned counsel for the petitioner contends that it is alleged in the FIR that the petitioner alongwith co-accused had cheated the complainant for Rs.55 lakhs on the pretext of sending him to USA. However, it is stated that the petitioner is an ex-serviceman and is not indulged in these activities. He further contends that the present FIR is false as the complainant has not shown any resources from where Rs.55 lakhs were procured and no amount has bene paid to the petitioner.

This Court, vide order dated 02.04.2025, had directed the petitioner to appear before the Investigating Officer and join investigation and in the event of his arrest, he was ordered to be released on ad-interim bail to the satisfaction of the Investigating/Arresting Officer, subject to the conditions envisaged under Sonia Puri 2025.05.20 09:50 I attest to the accuracy and integrity of this document

Learned State counsel on instructions submits that the petitioner has joined the investigation and is not required for custodial interrogation. 5.

In view of the submissions of learned counsel for the petitioner especially when the petitioner having joined investigation, the order dated 02.04.2025 granting interim bail to the petitioner is made absolute. 6.

However, the petitioner shall abide by the conditions stipulated under Section 438(2) Cr.P.C. He shall also join investigation as and when called upon to do so.

The petition stands allowed.
