**** ANITA CHAUDHRY, J(ORAL) The petitioner is seeking regular bail in FIR No. 77 dated 7.9.2016 registered at Police Station Kanwan, District Pathankot under Sections 506 IPC and Section 8 of the POCSO Act. Counsel for the petitioner contends that the petitioner is in custody since 7.9.2016 and challan has been presented. Counsel further contends that there were previous litigation between the complainant and the petitioner and a false case had been lodged. Counsel refers to Annexure P-2 and states that revision has been filed which is pending. Counsel further states that the alleged incident is of 30.8.2016 and the allegations are that the petitioner picked up the six year old girl and kissed her on the cheeks and the FIR has been lodged on 7.9.2016. Counsel further contends that the complainant side is well connected and investigation is over. State counsel submits that Section 294 along with 506 IPC and Gurpreet Singh Bhatia 2016.11.16 10:30 I attest to the accuracy and authenticity of this document High Court Chandigarh

Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
