NARESH KUMAR SANGHI, J (Oral) Prayer in this petition, filed under Section 439, Cr.P.C., is for grant of bail to the petitioner, Rakesh, son of Sumer Singh, resident of village Sheharmalpur, District Panipat, who has been booked for having committed the offences punishable under Sections 120-B, 408, 411, 419, 420, 467, 471, 478 and 480, IPC, in a case arising out of FIR No. 241, dated 8.5.2015, registered at Police Station, Palam Vihar, Gurgaon.

Learned counsel contends that the only allegation against the petitioner is that the main accused, Vinod, and his brother, Parmod, had kept the amount in a bag at the shop of the PRASHANT KAPOOR 2015.11.05 09:07 I attest to the accuracy and authenticity of this document

CRM-M-37003-2015 -2petitioner after withdrawing from the ATM of the bank. He further contends that all the offences for which the petitioner has been booked, are triable by learned Judicial Magistrate First Class and that the petitioner is behind the bars from 4.7.2015. He further submits that the charge-sheet (challan) has been presented after completion of the investigation qua the petitioner.

Learned counsel for the State has not controverted the submissions raised by learned counsel for the petitioner. In view of totality of the facts and circumstances of the case, the present petition is allowed. The petitioner, Rakesh, son of Sumer Singh, resident of village Sheharmalpur, District Panipat, is directed to be released on bail during pendency of the trial of the present case subject to his furnishing bonds to the satisfaction of learned Trial Court.
