******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 578 dated 28.10.2013 registered for offences punishable under Sections 406, 420, 506 and 120-B of Indian Penal of Code (for short 'IPC') at Police Station Yamunanagar City, District Yamunanagar. Vide order dated 03.02.2014, the petitioner was allowed interim bail. The presentation of challan in this case had been stayed vide order dated 15.11.2013 passed in connected petition CRM-M-38633 of 2013, which has been finally disposed of today. The dispute pertains to transaction of land and custodial interrogation of the petitioner to complete the investigation is not required. It is nowhere alleged that the petitioner is not cooperating in investigation.

In view of above but without expressing any opinion on the Jitender Kumar 2017.04.24 17:15 I attest to the accuracy and integrity of this document CHANDIGARH

CRM-M-3712 of 2014 -2merits of the case, this petition is allowed and order dated 03.02.2014 is made absolute till the presentation of challan, subject to the following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave India without the prior permission of the Court.

(iv) that the petitioner will seek regular bail on the presentation of challan in Court.
