(ORAL) The petitioner, through the instant petition under Section 482 Cr.P.C., is seeking direction to official respondents to conduct fair and impartial investigation in FIR No. 219 dated 18.12.2022, under Sections 363 and 366 IPC, registered at Police Station, Division-2, District Pathankot.

Learned counsel for the petitioner inter alia contends that daughter of the petitioner namely Priyanka Devi has solemnized marriage with Rajan-respondent No. 4. Respondents No. 4 and 5 have filed Criminal Writ Petition No. 12128 of 2022 before this Court seeking protection of their lives and liberty. The respondent No. 5 has wrongly disclosed his age 18 years and 10 months. She was minor at the time of solemnizing marriage. The petitioner has filed PARAMJIT KAUR SAINI 2023.04.24 17:42 I attest to the accuracy and authenticity of this order/judgment

2023:PHHC:057311 CRM-M-20145 of 2023 -2representation to higher police officials as well as got lodged FIR, however, police is not taking appropriate action. Learned State counsel, who on advance notice, is present in Court, submits that police is enquiring into birth certificate of respondent No. 5 and matter is under investigation. He further submits that this Court in CRWP No. 12128 of 2022 has directed SSP, Pathankot to look into representation of the petitioners therein, thus, it would not be just and fair to initiate action against respondents No. 4 and 5 especially when respondent No. 5 i.e. daughter of the petitioner is staying with respondent No. 4. Nevertheless, he submits that police is investigating the matter and would take appropriate action in accordance with law. This Court is sanguine of the fact that investigating officer would fairly conduct investigation and bring the matter to a logical end.
