This is a petition under Section 439 Cr.P.C. seeking regular bail to the petitioner in case FIR No.74 dated 1.4.2021 under Sections 354-D, 452, 506, 376, 511, 376-D, 354-A read with Section 34 IPC and Sections 4 and 12 of POCSO Act, 2012, registered at Police Station Lakhan Majra, District Rohtak. As per allegations in the FIR, the petitioner committed rape upon the victim, aged about fourteen years on 15.3.2021, and attempted to do it again along with two other friends on 31.3.2021. On her raising noise, all the three ran away from the spot.

Learned State counsel, on instructions from ASI Pawan, submits that fourteen out of twenty witnesses have been examined, and the remaining witnesses have been summoned for 16.3.2023 by the trial Court. There is another case against the petitioner, i.e., FIR No. 391 of 2017 under Sections 332, 353 and 186 IPC registered at Police Station City Rohtak, District Rohtak. Keeping in view the aforesaid facts, it is apparent that trial of the case is about to conclude, and there is another criminal case against the ASHWANI KUMAR 2023.03.13 19:11 I attest to the accuracy and integrity of this document

CRM-M No. 21337 of 2022 -2petitioner. Therefore, this Court is not inclined to grant concession of regular bail to the petitioner at this stage.
