(ORAL) Through this second petition, the petitioner seeks anticipatory bail in case bearing FIR No.92 dated 31.05.2021, registered under Sections 306, 506, 149 IPC; Sections 3(2) and 5(v) of SC & ST Act and Section 34 IPC (added) and Section 149 IPC (deleted later on), at Police Station Kotbhai, District Sri Muktsar Sahib. Status report by way of an affidavit dated 01.08.2023 of the Deputy Superintendent of Police, Sub-division Gidderbaha, District Sri Muktsar Sahib, filed on behalf of the respondent-State, in the Registry, is taken on record.

Vide order dated 21.04.2023 passed by a this Court, the petitioner had been granted ad interim pre-arrest bail and directed to join the investigation.

CRM-M-19949-2023 (O&M) -2Learned Senior counsel for the petitioner submits that as per the Status report, during investigation, the petitioner was found innocent and is not required for further investigation. Learned State counsel, on instructions from HC Harpreet Singh, submits that the petitioner has joined the investigation and is now not required for any further investigation.

In view of the above, without commenting on the merits of the case, the present petition is allowed and the order dated 21.04.2023 granting interim bail to the petitioner, is made absolute, subject to the conditions laid down in Section 438 (2) of the Code of Criminal Procedure.
