The petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.170 dated 5.7.2018 registered for the offences under Sections 15, 18, 21, 22/66-C, 8A(a)/61 of Narcotic Drugs and Psychotropic Substances Act, 1985 (hereinafter referred to as `the Act') and Sections 25 and 27 of Arms Act at Police Station Sadar Ferozepur, District Ferozepur.

Notice of motion has been issued in this case. Ms. Monika Jalota, learned Deputy Advocate General, Punjab has appeared on behalf of the respondent-State and contested this petition. I have heard learned counsel for the petitioner as well as learned State and have gone through the record. The FIR in the present case has been registered on the general allegations that the present petitioner along with his son have purchased HARPAL SINGH PARMAR 2018.11.13 16:41 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-38045 of 2018 [2] properties and cars etc. with the money earned by smuggling of drugs and narcotics etc.

Learned counsel for the petitioner argued that the petitioner has inherited the properties from his father and placed on record copies of Jamabandis etc. He also argued that in the last about six years the petitioner has purchased only 13 Kanals of the land and the car has been purchased by raising bank loan.

The petitioner has already joined the investigation. The case is based on documentary evidence. He is not required for custodial interrogation. No useful purpose will be served by sending the petitioner to custody.

Keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the case, I find merit in this petition and the same is allowed. The interim order dated 18.9.2018 passed by this Court granting interim bail to the petitioner is made absolute. However, the petitioner shall join the investigation as and when called upon to do so and shall abide by the conditions of Section 438 (2) Cr.P.C. November 12, 2018.
