The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered against him vide FIR No.127, dated 10.6.2015, Police Station Gobindgarh Mandi, District Fatehgarh Sahib, under Sections 406, 420 IPC. 2.
At the time of issuance of notice of motion, the following order was passed by this Court on 17.6.2021:
"It is the contention of learned counsel for the petitioner that after the registration of the FIR against the petitioner, there
- 2 - was a compromise, which was entered into between the petitioner and the complainant. On the basis of the said compromise, the matter having been amicably resolved, petitioner was of the view that the cancellation report will be submitted by the police, however, challan under Section 173 Cr.P.C. was presented without intimation to the petitioner. Because of the petitioner not knowing the factual aspect with regard to the presentation of the challan, he did not appear before the Court. He has now come to know about the issuance of non-bailable warrants against him and, therefore, had approached for the grant of anticipatory bail, which has been rejected by the Court below. Counsel contends that the next date of hearing before the trial Court is 06.08.2021 and the petitioner would appear before the said Court and face the trial.

On the asking of the Court, Mr. S.P.S. Tinna, Additional Advocate General, Punjab, accepts notice. In the light of the statement made by the counsel for the petitioner and keeping in view the fact that the matter has been said to be compromised between the parties, petitioner is permitted to appear before the trial Court on or before 06.08.2021.
On appearance before the trial Court, he shall be admitted to bail to the satisfaction of the trial Court/Chief Judicial Magistrate/ Duty Magistrate concerned. List for consideration on 11.08.2021."

Learned counsel for the petitioner stated that infact the petitioner also appeared before the trial Court and has furnished surety bonds and bail bonds and has been regularly appearing thereafter.

In view of the aforestated position, the petition is accepted and interim directions issued by this Court vide order dated 17.6.2021 are hereby made absolute subject to the condition that the petitioner shall regularly appear before the trial Court and abide by the conditions as provided under Section 438 (2) Cr.P.C.
