MANJARI NEHRU KAUL , J. (ORAL) Petitioner is seeking quashing of order dated 20.05.2022 (Annexure P-5) passed by learned Judicial Magistrate 1st Class, Kapurthala, whereby the petitioner had been declared as proclaimed person in case FIR No.54 dated 08.06.2021 under Sections 420, 120-B of the IPC registered at Police Station Dhilwan, District Kapurthala. 2.
In compliance of order dated 24.04.2024, learned counsel for the petitioner has placed on record duly attested photocopy of the air tickets of the petitioner qua his intended travel to India. As per the air tickets, which have been placed on record, the petitioner is due to arrive in India on 05.08.2024 and is due to fly back to Vancouver on 20.08.2024.

Learned counsel for the petitioner submits that the petitioner is ready and willing to appear and surrender before the trial Court after his arrival in India. Hence, in the aforementioned facts and circumstances, petitioner be protected till his appearance before the trial Court and directions be given to the trial Court that his bail application, PUNEET SACHDEVA 2024.05.23 16:30 I attest to the accuracy and integrity of this document Chandigarh

Notice of motion.

On asking of the Court, Mr. Navdeep Singh, Deputy Advocate General, Punjab, accepts notice on behalf of respondent No.1-State.

In view of the limited prayer made by the learned counsel for the petitioner, the instant petition is disposed of with directions to the petitioner to appear and surrender before the trial Court on or before 10.08.2024. Till then, no coercive steps be taken against the petitioner between 05.08.2024 and 10.08.2024, or till he appears and surrenders before the trial Court, whichever is earlier. 6.
It is made clear that in case, the petitioner fails to surrender before the trial Court on or before 10.08.2024, this order shall be of no avail to him thereafter. In case, on appearance and surrender, the petitioner moves an application for bail, the trial Court shall make earnest efforts to decide it expeditiously, in accordance with law.
