IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH CRM-M-37163 of 2017 Date of Decision: 01.12.2017 Karambir ....Petitioner

Versus

State of Haryana ....Respondent CORAM: HON'BLE MR. JUSTICE RAMENDRA JAIN Present: - Mr. Subhash Godara, Advocate, for the petitioner. Mr. Surender Singh, AAG, Haryana.

RAMENDRA JAIN, J. (ORAL) Prayer in the instant second petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioner Karambir in a case arising from FIR No.376 dated 26.10.2016 registered under Sections 406, 420, 467, 468, 471 and 120-B IPC at Police Station Madhuban, District Karnal.

According to the prosecution, petitioner obtained a job in the police department of the Government of Haryana and served the same for around 26 years by furnishing a forged matriculation certificate. Learned counsel for the petitioner inter alia contends that at the time of rejection of earlier bail application of the petitioner, final report under Section 173(2) Cr.P.C. was not presented, which now has been filed. Therefore, the instant petition has been filed on the basis of changed circumstances. The conclusion of trial shall take a long time. No useful purpose would be served by detaining the petitioner in jail. Ravinder Singh 2017.12.02 12:39 I attest to the accuracy and authenticity of this document On the other hand, learned State counsel vehemently opposed the prayer for grant of regular bail to the petitioner.

-2CRM-M-37163 of 2017 Considering over-all facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on bail, on his furnishing bail bonds and surety bonds, to the satisfaction of Trial Court/Duty Magistrate concerned.
