Mr. Ravinder Hooda, Advocate for the petitioners. Mr. Ankur Mittal, Additional Advocate General, Haryana. **** AVNEESH JHINGAN, J (Oral) [1] The matter is taken up for hearing through video conference due to COVID-19 situation.
[2] This petition in the nature of Habeas Corpus was filed for release of detenues namely Narender, Vijay and Dharmender from the illegal custody of respondent No. 4.
[3] Notice of motion was issued. Status report was filed. Paragraph No.3 of the reply is quoted below:- "3.
That the present petition is wholly misconceived and has been maliciously filed by the petitioners despite having every knowledge of the fact that the alleged detenues have been duly arrested on 10.06.2021 as per due procedure laid down by law. CRWP-5397-2021 shall be pertinent to mention here that the alleged detenues were arrested from the area of P.S. Gohana, District Sonipat by the Special Staff, Hisar, after receipt of appropriate evidence against them with regard to their involvement in the FIR aforementioned." [4] Learned counsel for the petitioner submits that albeit as per the reply, detenues were arrested on 10.06.2021, the grievance survives regarding illegal detention was from 4.5.2021 to 9.6.2021. He seeks permission to withdraw the present petition with liberty to avail remedies in accordance with law.
