*** HARSH BUNGER, J. (Oral) The present petition has been filed under Articles 226/227 of the Constitution of India inter alia seeking a writ in the nature of Mandamus for staying the operation of order dated 12.03.2025 (Annexure P-1) passed by the Deputy Commissioner, Panchkula, whereby the petitioner has been suspended from the post of Sarpanch of Village Shamtu, Tehsil and District Panchkula.

Learned counsel for the petitioner submits that the appeal filed by the petitioner against the aforesaid order dated 12.03.2025 (Annexure P-1) is pending consideration before the Commissioner, Ambala Division, Ambala, which has not been taken up for hearing till date and now the matter stands adjourned to 09.04.2025.

CWP-9180-2025 (O&M) -2the petitioner would be satisfied if appropriate directions are issued to respondent No.2 (Commissioner, Ambala Division, Ambala) for deciding the stay application filed along with the statutory appeal preferred by the petitioner.

On advance service of copy of petition, Mr. Sandeep Singh Mann, Addl, A.G., Haryana appears on behalf of the respondent-State. 4.

Learned State counsel on instructions from Mr. Samta, ADA, Divisional Commissioner, Ambala, submits that the stay application along with the aforesaid appeal shall be decided by the concerned Officer/Authority on the date fixed i.e. 09.04.2025 and in any case, not beyond a period of two weeks thereafter, after affording due opportunity of hearing to the parties.

Keeping in view the submissions made by learned State counsel, the present writ petition is disposed of accordingly. 6.
