Learned counsel for non-applicant/appellant has rendered no objection, if the same is allowed.
Keeping in view the averments made in the application, the same is allowed and the appeal is ordered to be taken up on board today itself.
RSA No.1464 of 2001 As per order dated 10.01.2023, it has been brought on record that appellant has expired and counsel for appellant was directed to move an appropriate application for impleading the LRs of deceased appellant. Learned counsel for appellant has stated that despite the best efforts none of the LRs of deceased appellant have come forward for pursuing with the present appeal.

2024:PHHC:110835 RSA No.1464 of 2001 (O&M) As none of the LRs of deceased appellant are coming forward for pursuing the present appeal and keeping in view the aforesaid statement made by learned counsel for appellant, the present appeal is dismissed for want of prosecution.
However, the appeal may be revived again, if any such application is moved by the LRs of deceased appellant within a period of three months from the date of this order.
