(ORAL) This is a petition that has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioner in case FIR No. 441 dated 06.09.2017 under Sections 328, 376, 506 IPC and Section 6 of POCSO Act, registered at Police Station Rai, Sonepat District Sonepat. Learned counsel appearing on behalf of the petitioner would contend that the petitioner has been falsely implicated in the said FIR and has been in custody since 11.09.2017. He prays for grant of regular bail to the petitioner herein by contending that material witnesses have already been examined.

Learned counsel for the respondent-State contends that the trial is at the fag end since out of 16 witnesses, 15 have been examined and the SATYAWAN 2018.10.30 17:30 I attest to the accuracy and authenticity of this document High Court Chandigarh

CRM-M-38137-2018 DNA report is awaited. It is only on this account, the trial has not concluded.

I have heard learned counsel for the parties. In view of the fact that the trial is at the fag end; there are serious allegations against the petitioner herein and without commenting on the merits of the case this Court is not inclined to grant bail to the petitioner herein.

Dismissed.
