Learned State Counsel on instructions from ASI Jaswant Singh submits that after conclusion of the inquiry, cancellation report was filed. A statement to the said effect was given by the State Counsel on 21.09.2020. The cancellation report was eventually submitted before this Court, however, the Illaqa Magistrate directed a further investigation. Counsel on instructions from ASI Jaswant Singh submits that after re-investigation in the matter, the cancellation report had been filed yet again on 21.08.2023 and the factum thereof stands recorded by this Court in its order of 05.09.2023. He thus contends that no investigation is pending against the petitioner and the matter is now sub judice before the Illaqa Magistrate.

Taking into consideration the fact that the cancellation report has already been filed by the respondents with the Illaqa Magistrate on 21.08.2023, the present petition is disposed of as having been rendered infructuous at this stage. It is, however, directed that the concerned Illaqa Magistrate shall take an expeditious decision on the cancellation report that is pending before it in case FIR No. 44 dated 03.04.2018 registered under Section 447/511 of the Indian Penal Code, 1860 at Police Station Dharmkot, District Moga within a period of four months of the date next fixed before the Illaqa Magistrate.
