(ORAL) The petitioner has filed the present petition, for initiation of contempt proceedings, against the respondents, on account of wilful defiance of the order dated 15.10.2025, passed by the Coordinate Bench, in CWP27857-2025, copy whereof is Annexure P-1. It is submitted that vide aforesaid order dated 15.10.2025, a time-bound direction was given by the Coordinate Bench, to the competent authority i.e. the respondents, to examine the legal notice and pass an appropriate order, within a period of four months from the date of communication of copy of that order.

Further, it is submitted that in consonance with the aforesaid order, the petitioner had filed a representation dated 25.10.2025, copy whereof is Annexure P-6, thereby bringing the order passed by the Coordinate Bench, to the notice of the Deputy Commissioner, Faridkot. Thereafter, there was no response from the respondents. Again, he had filed another representation dated 22.12.2025, before the Executive Officer, Municipal Council, Kotkapura, copy whereof is Annexure P-7, whereby requisite order passed by Coordinate Bench was brought to the notice of the concerned authority.

Notice of motion.

At this stage, Ms. Jagriti Kalia, AAG, Punjab, accepts notice on behalf of respondent No.1. Mr. Sarbuland Singh Mann, Advocate, accepts notice on behalf of respondent No.2 and filed memorandum of appearance, which is taken on record.

Counsel for respondent No.2 has brought to the notice of this Court that speaking order dated 01.04.2026, has been passed by the Executive Officer, Municipal Council, Kotkapura, thereby considering the legal notice, issued by the petitioner, for grant of compensation, but however, the same was denied, as the requisite documents required, were not produced.

In view of the order dated 01.04.2026 passed by the Executive Officer, Municipal Council, Kotkapura, at this stage, counsel for the petitioner submits that he does not want to pursue with the contempt petition

and the same be dismissed as withdrawn, with liberty to assail the speaking order dated 01.04.2026.

Ordered accordingly.
