HARSH BUNGER, J. (ORAL) Prayer in the present petition, filed under Section 482 of the Code of Criminal Procedure, is for setting aside the order dated 28.02.2019 (Annexure P-3) passed by Civil Judge (Junior Division)/Judicial Magistrate Ist Class, Faridabad, in case FIR No.0117 dated 04.04.2017, registered under Section 406 of the Indian Penal Code, 1860, at Police Station Ballabhgarh Sadar, District Faridabad, whereby, the petitioner was declared as proclaimed person due to his non-appearance on the date fixed. Mr. Ankit Singla, Advocate, appears and files fresh Power of Attorney on behalf of the petitioner, having no objection from the earlier counsel. The same is taken on record, subject to all just exceptions. At the very outset, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to file a fresh one with better particulars.
