**** RAMESHWAR SINGH MALIK J. (ORAL) Petitioners, by way of instant petition under Section 482 Cr.P.C., seek transfer of the investigation of the case arising out of FIR No. 73 dated 14.8.2014 under Sections 448/454/380/34 IPC, registered at Police Station Dugri, District Ludhiana City to any independent agency like Crime Banch etc.

Notice of motion was issued and pursuant thereto reply by way of affidavit dated 20.5.2015 of Ramandeep Singh, Assistant Commissioner of Police, Atam Nagar, Ludhiana, was filed on behalf of respondents No. 1 to 4.

Learned counsel for the State submits that after conducting free and fair investigation, police report under Section 173 Cr.P.C. has already been presented to the learned court of AMIT KUMAR 2015.07.23 17:21 I attest to the accuracy and authenticity of this document

CRM-M-37278 of 2014 competent jurisdiction as far back as on 25.3.2015 and the case was fixed for framing of charge on 11.6.2015. However, since the petitioners did not appear before the learned trial court, bailable warrants have been issued against them for 12.8.2015. She further submits that in this view of the matter, present petition does not survive any further and the same may be disposed of, as such. Faced with the above, learned counsel for the petitioners also fairly states that let the present petition be disposed of in view of the statement made by learned counsel for the State but liberty may be granted to the petitioners to avail their other remedies, in accordance with law.

In view of the above statements made by learned counsel for the parties, instant petition is disposed of with liberty as prayed for.
