CRM-M-21107-2022(O&M) and -2other connected cases by three accused in a common FIR. They pray for grant of regular bail pending trial in a criminal case arising from FIR No.75, dated 19.04.2022, registered under Sections 354-D, 341, 366, 379-A, 506, 509, 511, 34 IPC at Police Station 36, Chandigarh.
In substance, it is the case of the prosecution that the petitioners stopped the girls and started making obscene gestures and using vulgar language. As the girls retraced their steps to their college, the petitioners followed them. The petitioners are in custody since 20.04.2022. The Police after conclusion of the investigation, has presented challan (final report) and no challan under Section 366 IPC has been presented. The petitioners are students and does not have any other criminal antecedents. The conclusion of the trial is likely to take a long time. The petitioners are in the judicial custody. They have already suffered incarceration for a period of one and half month. Hence, further incarceration of the petitioners, at this stage, is not considered appropriate.
Without commenting on the merits of the case and keeping in view the aforesaid facts, it is considered appropriate to release the petitioners on regular bail on furnishing bail bonds/surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate/Area Magistrate. The petitions stand allowed All the pending miscellaneous applications, if any, are also disposed of.
