RAMENDRA JAIN, J. (ORAL) Prayer in the instant petition under Section 439 Cr.P.C. has been made for grant of regular bail to petitioners Sanjay and Jitender @ Kalu in a case arising from FIR No.66 dated 06.05.2018 registered under Section 20 of the Narcotic Drugs and Psychotropic Substances Act, 1985 at Police Station Pillu Khera, Jind.
According to the prosecution, on 06.05.2018 petitioners were apprehended with conscious possession of 2 kgs 950 grams charas without any permit or license. Since then they are in custody. Learned counsel for the petitioners inter alia contends that FSL report has not yet been received. Therefore, it cannot be said at this stage that alleged recovered article was a narcotic substance. In view of above, but without expressing any opinion on the merits of the case, the petitioners are granted interim bail subject to furnishing personal bonds and two sureties of `2.00 lakh each, to the satisfaction of Special Court concerned only till receipt of the FSL report. The petition stands disposed of accordingly.
