This is a petition for grant of regular bail to the petitioner in case FIR No. 48 dated 13.6.2013, registered under Section 409 & 120-B IPC at Police Station City Banga, District S.B.S.Nagar. Learned counsel for the petitioner submits that apart from the merits of the present case, the petitioner is in custody for more than two years.

Learned Deputy Advocate General, on instructions from Assistant Sub Inspector Baldev Singh, has accepted this fact. He further submits that out of 21, 19 witness have been examined and the matter is now fixed for 9.11.2015 and only official witnesses remain to be DEEPAK KUMAR BHARDWAJ 2015.11.07 12:57 I attest to the accuracy and authenticity of this document

Criminal Misc. No. M-37218 of 2015 examined. He submits that it would be more appropriate to put a time cap and undertakes to conclude the entire evidence of the prosecution within one one month.

In these circumstances, this petition is dismissed but the trial Court is directed to release the petitioner on bail in case the prosecution does not conclude its entire evidence by 5.12.2015, subject to the accused not obstructing the same.
